This document meets the stipulations and conditions mentioned in Section 65B (2) of the Indian Evidence Act, 1872.

We may periodically change the Terms and the Site without notice. You are responsible for checking these Terms periodically for revisions. All amended Terms become effective upon being live on the Site, and any use of the site after such revisions have been posted signifies your consent to the changes.

CHARGES
TOGNPL reserves the right to charge subscription and / or membership fees from a user, by giving reasonable prior notice, in respect of any product, service or any other aspect of this Site.
REGISTRATION ACCESS & USE
All information received by us from your registration on tomorrowsindia.com or other digital products of TOGNPL will be used by TOGNPL in accordance with our Privacy Policy. Kindly refer to the below mentioned information for details.
On registration, we expect you to provide TOGNPL with accurate and complete information of the compulsory fields. We also expect you to keep the information secure, specifically access passwords and payment information. Kindly update the information periodically to keep your account active. TOGNPL will rely on any information you provide to us.
Each registration is for a single user only. On registration, you will enter a user name and password ('ID'). You are not allowed to share your ID or give access to your account to anyone else. TOGNPL premium/free/complimentary subscription does not allow multiple users on a network or within an organization to use the same ID.
On knowledge, TOGNPL may cancel or suspend your access to TOGNPL premium/free/complimentary services if it comes across that you are sharing your personal access.
You are responsible for all the use of tomorrowsindia.com premium/free/complimentary service made by you or anyone else using your ID and for preventing unauthorized use of your ID. If you believe there has been a breach of security such as the disclosure, theft or unauthorized use of your ID or any payment information, you must notify TOGNPL immediately by e-mailing us at complaince@tomorrowsindia.com. We recommend that you do not select an obvious user password (such as your name) and that you change it regularly.
If you provide TOGNPL with an email address that will result in any messages TOGNPL may send you being sent to you via a network or device operated or owned by a third party (e.g. your employer or college) then you promise that you are entitled to receive those messages. To ensure emails land in your inbox, you will add the TOGNPL receipt id to your safe list. You also agree that TOGNPL may stop sending messages to you without notifying you. We may, in exceptional circumstances cease to provide subscription services. We will give you at least 7 days’ notice of this, if possible. If we do so, then we will have no further obligation to you.
Types of Subscription
Services may differ from country to country and the device from which you subscribe. Subscription packages and prices may also vary from time to time.
Pricing
The subscription prices shall be determined by the Company, by its sole discretion.
When you purchase a subscription, you must provide us with complete and accurate payment and other information required by the Company. By submitting payment details you represent, warrant and undertake that you are entitled to purchase a subscription using those payment details. If we do not receive payment authorization or any authorization is subsequently cancelled, we may immediately terminate or suspend your access to your subscription-based service or your entire access to Services on the Site. In suspicious circumstances, we may contact the issuing bank/payment provider and/or law enforcement authorities or other appropriate third parties. If you are entitled to a refund under these terms and conditions, we will credit that refund to the card or other payment method you used to submit payment, unless it has expired in which case we will contact you. Company uses third party payment gateway services for receiving payment from Users for its subscription-based Services and you hereby agree to your details and information being shared with such third-party payment service providers.
Subscription Contract
For our subscription-based Service, Company shall endeavour to process your subscription promptly but Company does not guarantee that your subscription will be activated by any specified time. By submitting your payment and other subscription details, you are consenting to buy a subscription. The consent will only be accepted by us and a contract formed when we have successfully verified your payment details and email address, at which point we will provide you with access to your subscription. Company reserves the unfettered right to reject any offer made by its Users, at its discretion, for any or no reason.
Taxes
Subscription and access to subscription based Services fall under the purview of applicable Tax laws of India. Taxes are applicable for consumption of content on the website and other Services of Company for Users based in India and outside the country. Unless otherwise indicated, prices stated on the Site are inclusive of applicable taxes, including but not limited to Goods and Services Tax (GST) or other applicable taxes.
Other costs
In addition to any subscription fees you pay for our subscription based Services, you are responsible for paying any internet connection or other telecommunications charges or any other costs or charges that you may incur by accessing the Services and/or subscription based Services. For example, if you use any of our mobile services then your network operator may charge you for data or messaging services.
COPYRIGHT AND TRADEMARKS
Unless otherwise stated, copyright and all intellectual property rights in all material presented on the Site (including but not limited to text, audio, video or graphical images), trademarks and logos appearing on this Site are the property of TOGNPL, its parent, affiliates and associates and are protected under applicable Indian laws. You agree not to use any framing techniques to enclose any trademark or logo or other proprietary information of TOGNPL; or remove, conceal or obliterate any copyright or other proprietary notice or any credit-line or date-line on other mark or source identifier included on the Site / Service, including without limitation, the size, color, location or style of all proprietary marks. Any infringement shall be vigorously defended and pursued to the fullest extent permitted by law. It shall be taken note that TOGNPL have limited rights over the intellectual property of its parent, affiliates and associates as per the respective agreement(s) or arrangement(s) whereas TOGNPL is bound to follow the respective agreement(s) or arrangement(s) and users of tommorrowsindia.com are bound with that particular agreement(s) or arrangement(s). CONTENT OWNERSHIP
All Content created and published on the digital platforms under the url https://www.tomorrowsindia.com the mobile browser site, applications, TOGNPL's Newsletter belong to TOGNPL and its licensors who own all intellectual property rights (including copyright and database rights) No intellectual property rights in any of the content are transferred to you while you consume the content on this platform. "Tomorrow's India" is registered trade mark of TOGNPL and you may not use them without prior written permission from TOGNPL. You are permitted to use the content on this platform only as set out in our Policy.
MATERIAL POSTED/TRANSMITTED AT TOGNPL'S SITE
All information, data, text, software, music, sound, photographs, graphics, video, messages or other materials ("Content"), whether publicly or privately transmitted / posted, is the sole responsibility of the person from where such content is originated (the Originator). You represent that you have valid rights and title in any and all Content/Images that you submit on the Site, that you have not infringed on any IPR belonging to any party and further that you will indemnify TOGNPL or its affiliates for all claims arising out of any content that you post on the Site.
Posting/uploading of any information or material, which is harmful, defamatory, obscene, pornographic, libellous, invasive of another's privacy, profane, hateful, or racially, ethnically objectionable, disparaging, or otherwise unlawful in any manner is prohibited and any person found to be involved in such activity on this website will solely be liable for actions under the applicable laws.
TOGNPL accepts no responsibility for the said Content / Images. However, you understand that all Content / Images posted by you becomes the property of TOGNPL and you agree to grant/assign to TOGNPL and its affiliates, a non-exclusive, royalty free, perpetual, irrevocable and sub-licenseable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such Content / Images (in whole or part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed throughout the world.
PROHIBITED ACTIVITIES
You shall not host, display, upload, modify, publish, transmit, store, update or share any information on the Site, that —

Any Content uploaded by you shall be subject to relevant laws and may be disabled, or and may be subject to investigation under appropriate laws. Furthermore, if you are found to be in non-compliance with the laws and regulations, these terms, or the privacy policy of the Site, we may terminate your account/block your access to the Site and we reserve the right to remove any non-compliant Content uploaded by you. Additionally, unlawful content will be removed on being notified by a government agency or by an order of any court or as required under applicable laws.
Any Content and or comment uploaded by you, shall be subject to relevant Indian laws and may be disabled, or and may be subject to investigation under appropriate laws. Furthermore, if you are found to be in non-compliance with the laws and regulations, these terms, or the privacy policy of the Site, the Company shall have the right to immediately terminate/block your access and usage of the Site and the Company shall have the right to immediately remove any non-compliant Content and or comment, uploaded by you subject to retaining such information as required under applicable laws and shall further have the right to take recourse to such remedies as would be available to the Company under the applicable laws.
TOGNPL reserves the right to preserve records of content transmitted by it as required under applicable laws.

However, TOGNPL cannot be held liable for any damage, direct or indirect, of whatever nature as a result of or related to the access to or use of the site. TOGNPL therefore does not give any guarantee with regard to:
The functioning of the website. Interruptions or malfunctions can under no circumstances give rise to any (financial) compensation for any damage whatsoever.
Cyber-attack or virus attack over the system and/or network of TOGNPL or/and user.

DELETIONS FROM SERVICE
TOGNPL will delete any materials at the request of the user who submitted the materials or at the request of an advertiser who has decided to "opt-out" of the addition of materials to its advertising, including, but not limited to ratings and reviews provided by third parties. TOGNPL reserves the right to delete (or to refuse to post on public forums) any materials it deems detrimental to the system or is, or in the opinion of TOGNPL, may be, defamatory, infringing or violate of applicable law. TOGNPL reserves the right to exclude Material from the Platforms. Materials submitted to TOGNPL for publication on the Platforms may be edited for length, clarity and/or consistency with TOGNPL's editorial standards.
INDEMNIFICATION
You agree to indemnify and hold us and (as apppcable) our parent, subsidiaries, affiliates, officers, directors, agents, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms, your violation of any law, or your violation of the rights of a third party, including the infringement by you of any intellectual property or other right of any person or entity. FORCE MAJEURE
In no event shall we or any Distribution Site be liabile or be deemed to be in breach hereof for any failure or delay in performance resulting from any governmental action, fire, flood, insurrection, earthquake, power failure, network failure, riot, explosion, embargo, strikes (whether legal or illegal), terrorist act, labor or material shortage, transportation interruption of any kind or work slowdown or any other condition not reasonably within our control. Your payment obligations shall continue during any event of force majeure.
ARBITRATION
Any disputes and differences whatsoever arising in connection with these Terms shall be settled by Arbitration in accordance with the Arbitration and Conciliation Act, 1996. a) All proceedings shall be conducted in English language. b) Unless the Parties agree on a sole arbitrator there shall be three Arbitrators, one to be selected by each of the parties, and the third to be selected by the two Arbitrators appointed by the parties. c) The venue of Arbitration shall be in Delhi, India.
CHANGES TO TERMS AND CONDITIONS AND VALIDITY
These terms and conditions were published on January, 2023 and replace with immediate effect the terms and conditions previously published.
